Article 1 — Definitions

"Trader": whateverplayground B.V., located in Amsterdam, KvK 42105232
"Consumer": the buyer who enters into an agreement via the webshop.

Article 2 — Identity of the trader

Article 3 — Applicability

These terms apply to every offer made by the trader and to every agreement between trader and consumer via the webshop.

Article 4 — The offer

The offer contains a complete and accurate description of the products. Obvious mistakes or errors do not bind the trader.

Article 5 — The agreement

The agreement is formed at the moment the offer is accepted (order placed) and the stated conditions are met.

Article 6 — Right of withdrawal

See the Returns Policy below; it forms part of these terms.

Article 7 — Prices

Prices include VAT. Shipping costs are shown separately at checkout.

Article 8 — Delivery

The trader takes the greatest possible care when fulfilling orders. The delivery address is the address provided by the consumer.

Article 9 — Payment

Payment is made via the payment methods offered on the website, unless otherwise agreed.

Article 10 — Complaints procedure

Complaints are answered within 14 days of receipt. See also Contact.

Article 11 — Liability

The trader's liability is limited to the invoice amount of the order, or to the amount paid out by the trader's liability insurance in the relevant case. The trader is not liable for indirect or consequential damages, except in cases of intent or gross negligence.

Article 12 — Disputes

If the customer and trader cannot resolve a dispute themselves, it may be submitted to the Thuiswinkel Disputes Committee (Geschillencommissie Thuiswinkel, Postbus 90600, 2509 LP The Hague, sgc.nl) or the European ODR platform (ec.europa.eu/consumers/odr) — in line with the approach used by Pinkpop and the current Lowlands shop.

Article 13 — Applicable law

Agreements between trader and consumer are exclusively governed by Dutch law.

Order withdrawal

A legally required form to be provided, enabling the consumer to withdraw from an order (name, order number, ordered/received on, IBAN). This is included as standard in the Stichting Webshop Keurmerk/Thuiswinkel model terms and can be adopted as-is.
